Member Qualifications

The membership of the Association shall consist of

  1. Full Members, who
    • are entitled to receive notice of and to attend every general meeting;
    • shall be included in computing a quorum; and
    • are entitled to vote at any general meeting,
  2. Associate Members, who
    • are entitled to receive notice of and to attend every general meeting;
    • shall not be included in computing a quorum; and
    • shall not be entitled to vote at any general meeting.
  • Full Member

    Unless the Council otherwise determines, a Firm shall be eligible for admission as and, upon admission, continuing to be a Full Member, or for transfer to that class, if and so long as it possesses one of the following qualifications, that is to say—

    • it has been registered in the List of Approved Contractors for Public Works maintained by the Development Bureau (including Buildings, Port Works, Roads & Drainage, Site Formation and Waterworks); or
    • it has been registered in the Register of General Building Contractors maintained by the Buildings Department; or
    • it has been registered in one of the Registers of Specialist Contractors maintained by the Buildings Department, provided that the relevant Register has been recognised and approved by the Council as a qualifying Register for the purpose of admission of a new Full Member (including Demolition Works, Foundation Works, Site Formation Works and Ground Investigation Field Works Category); or
    • it has been registered in the List of the Hong Kong Housing Authority Building Contractors provided that the relevant category of such contractors has been recognised and approved by the Council as qualifying category for the purpose of admission of a new Full Member (including Building Contractors – Maintenance and New Works); or
    • any qualification specified by the Council for admission as a Full Members in case the names of the various lists, register, governmental departments and authorities referred to in 1.1 to 1.4 change over time.
  • Associate Member

    Unless the Council otherwise determines, a Firm shall be eligible for admission as and, upon admission, continuing to be an Associate Member of the Association, if and so long as it possesses one of the following qualifications, that is to say—

    • it is in business in some branches of the Construction Industry either as a sub-contractor or as a trade specialist; or
    • it is in business as a construction material supplier; or
    • any qualification specified by the Council for admission as an Associate Member.

Remarks

  1. Each Firm admitted to membership of the Association shall within 14 days after its admission, pay the fee, subscription and other sums payable to the Association under these Articles.
  2. Annual subscription fees are due and payable immediately upon admission to membership, and thereafter annually on 1st January. In the year of admission, the annual subscription fees payable shall be a proportion of the annual amount based upon the month of admission.
  3. Any Firm whose membership ceases for any reason shall nevertheless remain liable to pay to the Association all moneys which at the time when its membership ceased may have been due from it.
  4. If any Member of any class shall neglect for 6 months to pay any money due from him to the Association, the Council may forthwith suspend its privileges of membership and may serve upon him a notice in writing appointing a day and place for payment together with a copy of this Article. If it continues in default for 1 month after service of such notice, its membership shall cease.
  5. If any Member of any class shall become bankrupt or unable to pay its debts when due or enter into any arrangement with its creditors, its membership shall cease if so resolved by the Council.
  6. Unless otherwise determined by the Council, any fees, subscriptions, calls, levies, contributions, and any other amounts whatsoever paid by a Member shall not be refundable upon the termination of its membership.
  7. The Council may from time to time determine what entrance fees (if any) shall be paid upon admission to membership or upon transfer from one class of membership to another, and the annual subscription fees (if any) payable in respect of each class of membership.
  8. The Council may, at its reasonable discretion, waive or exempt a Full Member or an Associate Member from payment of any entrance fee, annual subscription fee, contribution, Levy or any other sum otherwise payable by a Member upon such terms and for such period as it thinks fit.
